Please read these rules before entering the Math Madness Contest ("Contest"). By submitting an entry, you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of Sponsor and the judges, and that you satisfy all eligibility requirements.
Open to elementary, middle, and high school teachers who are legal residents of the 50 United States or the District of Columbia and who are the older of 18 years of age or the legal age of majority in their state of residence at the time of entry. Entrants must have the authority to enter the Contest on behalf of his/her elementary, middle, or high school which must (a) be an elementary, middle, or high school physically located in the 50 United States or the District of Columbia with 50 or more enrolled students; and (b) not be a home school (each a "School"). Entrants must already be registered or must sign up for a TenMarks Math teacher account at www.tenmarks.com/math-madness, https://www.tenmarks.com/signup, https://www.tenmarks.com/signup/teacher3, or https://www.tenmarks.com/signup/teacher4 to enter the Contest. There is no fee to register or maintain a TenMarks account. The Contest and these Official Rules are void where prohibited by law, and are subject to applicable U.S. federal, state and local laws. Entrants may not be members of any guild, union or other organization that may prohibit them from participating in this Contest and that would restrict, require due payment or otherwise have the right to oppose such entrant's participation in this Contest.
Not open to employees or independent contractors, or immediate family members (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren) or those living in the same household of employees or independent contractors of Sponsor, any entity involved in any aspect of the Contest (including funding, judging or administration), advertising agencies, and each of their respective parents, subsidiaries, affiliates, advisors, or advertising/promotion agencies.
Contest entry period begins at 12:00:01 a.m. (PT) on March 7, 2016 and ends at 11:59:59 p.m. (PT) on April 16, 2016 (the "Entry Period"). The Entry Period will be divided into six (6) weekly periods. Weeks are defined as Sunday - Saturday during the Entry Period with an exception for the first week that starts Monday, March 7, 2016 and ends Saturday March 12, 2016. Weekly prizes will be awarded based on the improvement shown from week to week by each Class (as defined below). Therefore, a weekly prize will not be awarded for the first week. To enter, during the Entry Period, you must follow the steps below:
You must have a TenMarks Math teacher account with at least one active class under the account. To sign up for an account, you must go to www.tenmarks.com/math-madness, https://www.tenmarks.com/signup, https://www.tenmarks.com/signup/teacher3, or https://www.tenmarks.com/signup/teacher4, create a teacher account (if you don't already have one) and create a class with at least 5 students (the "Class"). Any student that is or has been enrolled in a Class during the Entry Period will be considered a student in the applicable Class. We will use the maximum number of students enrolled in a class during each week to calculate the average number of questions for that particular week. Classes will be divided into the following groups by TenMarks Math grade level: "Group A" (grades 1-4), "Group B" (grades 5-7), and "Group C" (Grade 8, Geometry, Algebra 1-2 & Integrated Math 1-3) (each, a "Group").
An "Eligible Question" is understood as a TenMarks Assignment question coming from Class, Do-Over or Personal Assignments. Each completed Eligible Question that is fully submitted and graded in the TenMarks online service is referred to as an "Entry". To be eligible for prizes at least 70% of students in an applicable Class need to complete at least one (1) Eligible Question and the average number of Eligible Questions submitted per student has to be at least 10. All Entries will be counted towards the overall question count for the applicable week.
All Entries must be received by 11:59:59 p.m. (PT) on Saturday of each week during the Entry Period to be considered for a Weekly Prize and all Entries must be received by 11:59:59 p.m. (PT) on April 16, 2016 to be considered for a Grand Prize. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible Entries. Each Entry must be completed and submitted electronically through the TenMarks system.
All Entries determined by Sponsor in its sole discretion to meet the foregoing requirements will be deemed "Valid Entries." Sponsor's (or its contractor's) servers and clock shall be deemed the official clock for all phases of the Contest, and entrant's proof of a submission does not constitute proof of receipt by Sponsor. Sponsor is not responsible for (i) lost, misdirected, late, incomplete, illegible, or unintelligible Entries or for inaccurate entry information, whether caused by participant or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error that may occur in the processing of Entries; (ii) any printing, production, human or typographical errors in any materials associated with the Contest or (iii) any inconsistencies in tabulations of determination of whether answers are correct.
Sponsor reserves the right in its sole and unfettered discretion to disqualify at any time any Entry containing infringing or other inappropriate content or subject matter (as determined by Sponsor in its sole discretion) or that is not otherwise in compliance with these rules.
All Entries must be the original creations of the entrants, and by submitting an Entry, each entrant grants to Sponsor the non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the Entry throughout the world in any media.
At the conclusion of the Entry Period, Classes who have completed the highest average of Entries per enrolled student and whose Entries have an average score of 70% or higher in the TenMarks online service for at least 4 of the 6 weeks of the Entry Period will be placed into a corresponding finalist group for either "Group A", "Group B", or "Group C", as applicable. Data for the best 4 weeks of the 6-week total score of each Class' Entries will be used to compute the finalist Classes. One First Prize winning Class, one Second Prize winning Class, and one Third Prize winning Class in each Group will be determined based on the highest average number of Entries completed per student in that Group (for a total of 3 First Prize winning Classes, 3 Second Prize winning Classes, and 3 Third Prize winning Classes throughout all Groups). Winning Classes will be announced on or about April 25, 2016. In the event of a tie, the tie will be broken by the tied Entries being rated based on percent accuracy on Entries overall. In the event a potential winning Class' Entries are disqualified, the Class who submitted the next highest average scored Entries will be a potential First Prize winner, Second Prize winner, or Third Prize winner in that Group, as the case may be, and must comply with the requirements in these Official Rules. All decisions of Sponsor are final and binding.
Starting on March 22, 2016 at 10:00 am (PT) and ending on April 19, 2016 at 10:00 am (PT), Weekly Prizes will be announced and awarded on a weekly basis to a Class in each Group for those Entries that have shown the most improvement week over week in the overall percent of Entries answered correctly. To be eligible for a Weekly Prize a class needs to reach at least an average 30% accuracy. Improvement will be calculated by comparing the percent correct week over week across all the Entries the Class has submitted within a week. The top Class in each Group will be determined based on the largest week over week improvement in overall correctness. In the event of a tie, the tie will be broken by the tied Entries being rated based on how many Entries the Class has completed. In the event a potential winning Class' Entries are disqualified, the Class who submitted the next most improved Entries will be a potential Weekly Prize winner, as the case may be, and must comply with the requirements in these Official Rules. All decisions of Sponsor are final and binding.
We will award the following prizes in each Group as described below.
We will award a total of 15 Weekly Prizes as described below.
All prizes will be accepted by the teacher on behalf of the class and School. The total ARV of all prizes is $34,048.65. Each third prize winner must have or will need to create an Amazon.com account in order to redeem the Amazon.com Gift Card ("GC"). The GC may only be used for purchases of eligible goods on Amazon.com or certain of its affiliated websites. Redemption of the GC will be subject to our standard terms, conditions and restrictions applicable to Amazon.com Gift Cards in effect on the day of issuance of the GC. The GC cannot be redeemed for the purchase of gift cards. Except as required by law, the GC cannot be reloaded, resold, transferred for value, redeemed for cash, or applied to any other account. Amazon is not responsible if any GC is lost, stolen, destroyed or used without permission. If the GC is lost or stolen, it will not be replaced. Each winning School will be responsible for paying all costs and expenses related to the prizes that are not specifically mentioned, including, but not limited to, taxes, and any other expenses that might reasonably be incurred by the winning School in receiving or using the prizes. Each winning School may be required to submit to Sponsor its social security number or tax payer ID number, or other such tax filing information required by Sponsor in order to claim the prize.
Sponsor reserves the right to substitute a prize (or portion thereof) for an item of comparable or greater value, in its sole discretion. All prizes will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
An authorized representative of each potential winning School will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release as requested by Sponsor. Prior to awarding a prize, Sponsor may, in its sole discretion, require the potential winners to sign such additional documents Sponsor decides are necessary to confirm eligibility, to obtain a liability/publicity release, and to award any prize. Failure to return any required document by the date requested by Sponsor will deem the winning School as ineligible to receive the prize. If any documentation is not returned by the specified dates or if a potential winner is deemed ineligible prior to the prize being awarded, Sponsor may, in its sole discretion, award the prize to the next entrant receiving the highest score.
To the maximum extent permitted by law, Sponsor reserves the right, in its sole discretion, to change these rules or cancel the Contest at any time, or to modify, terminate, or suspend the Contest should viruses, worms, bugs, unauthorized human intervention, or other causes beyond Sponsor's control corrupt or impair the administration, security, fairness, or proper play of the Contest or submission of Entries, or in the event Sponsor does not receive a minimum of 500 Entries per School, with a minimum of 50 Schools. Sponsor is not responsible for any human or other error that may occur in the processing of the Entries, nor is it responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction, or unauthorized access to, or alteration of, Entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any Web site. Sponsor is not responsible for injury or damage to any entrant's or any other computer resulting from downloading any materials in connection with the Contest. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process, the outcome of the Contest, or the operation of the Contest or Web site; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS AFFILIATES RESERVE THE RIGHT TO SEEK DAMAGES AND/OR OTHER RELIEF FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

No transfer, assignment, cash redemption or substitution of prizes is permitted except by Sponsor due to prize availability and then with prizes of equal or greater value. Entrants agree (for themselves and their heirs) that Sponsor, any entity involved in any aspect of the Contest (including funding, judging or administration), advertising agencies, contractors, and each of their respective parents, subsidiaries, affiliates, advisors, and advertising/promotion agencies (collectively, the "Released Parties") will have no liability, and will be held harmless by such entrants to the maximum extent permitted by law for any liability, loss, injury, or damage to property or to person, including death, and reasonable attorney's fees and court costs, due in whole or in part, directly or indirectly, by reason of participation in the Contest, or by reason of the acceptance, possession, use or misuse of the prizes, even if caused or contributed to by the negligence of any of the Released Parties. Contest is governed by the laws of the United States and the State of Washington. As a condition of participating in this Contest, entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in King County, Washington having jurisdiction. Further, in any such dispute, under no circumstances will entrants be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental or consequential damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (e.g. costs associated with entering), and entrant further waives all rights to have damages multiplied or increased. Entrants agree that the decisions of Sponsor related to the Contest are final. By participating in the Contest, entrants consent to the use of their names, biographical information, Entries, images and/or likenesses in any manner and in any medium for any purpose in connection with the Contest, including worldwide, without additional compensation, except where prohibited by law.
After the winners are confirmed, the winners' names will be posted at www.tenmarks.com/math-madness-results until July 26, 2016.
